Terms Of Business and Legal Rights

1)  Spare parts are supplied on a retail basis, trade (proof of trade or trade account number is required).   Customers please order direct by phone or email. 

2)  We reserve the right to supply good used parts when shortages occur, this means that it can sometimes take longer to supply parts.

3)  Spare parts may go out of stock too quickly for us to update the website.  We apologise for this in advance, and whilst we strive to supply every part on an order, sometimes items can go out of stock at short notice.  In the event of this happening, we will contact you to see what you want us to do, and if you need a refund or credit we can do this for you.

4)  In the event of non-delivery, please allow 3 weeks as Royal Mail do not consider an item lost until 3 weeks have past.  In the highly unlikely event that an item is lost, a full reimbursement will be given.

5)  Please keep a copy of your order.  Any shortfalls should be notified to us immediately upon receipt of your order.  This enables us to check our system and check with the person packing the order and QC department.

6)  Orders are processed in strict rotation, unless you contact us before ordering.

7)   Please note 7 to 10 days are required for Cheques/Postal orders before dispatch of your order.

8)  Goods are not supplied on a sale or return basis.  By Prior agreement, goods may be returned for credit, but a handling charge may be incurred.

9)  Card orders below £5 will be subject to a £2 charge before we can dispatch.  This is to cover card fees and admin time.

10)  All prices are correct at the time of publishing on the website, this can change without notice as manufacturers change their prices or supply of an item means we have to travel to find part/s.

11)  If you are seeking a part we do not have, we have a special order service, and can usually find the parts.  Contact us for more details.

12)  Goods are sent out at customers risk, we recommend using  a recorded/tracked service.

13)  International customers should contact us before ordering so we can sort out suitable carriage.  All overseas orders are tracked and insured delivery only.

14)  As we are small, we are unable to do any VAT reductions on orders to certain countries.  We hope this will change as our business keeps growing.

15)  We can reserve models, items or parts, however there is a no-refundable deposit which is the trade price we pay for the items.

16)  We obtain proof of posting as a minimum for all orders and this is recorded on our system.

17)  At peak times we can get very busy.   Please be patient with us as we try to cope with all calls and emails.

18)  PCB design work is done on a payment upon of completion of  design basis.   No final design work will be passed to the customer until payment is received.

19)  All Trade accounts must be paid pro-forma, we do not give credit.  Minimum first trade order must be £550 per order (Excludes delivery etc.).

20)  Trade customers must identify themselves with their trade account code.

21)  Faulty goods should be returned for inspection/testing before a refund can be issued.  This complements your statutory rights.

22)  Non payment for goods will result in an order being cancelled.  All orders must be paid for before dispatch.

23)  Our own products carry a lifetime repair guarantee, this is not valid if the item has been incorrectly fitted, altered, tampered with, or damaged by the end user.  Items that go faulty in normal use, should be returned to us for replacement or repair.

We as the trader/retailer have the right to supply the goods etc.

If statutory rights under a goods contract are not met.

As the consumer you have the  right to enforce terms about goods.

You have the right to reject or partially reject goods.  There is a time limit for short-term right to reject.

You have the right for right to repair or replacement of items, and right to a price reduction or to a final right to reject totally if the item is faulty under the Consumer Rights Act 2015.

 

Our Returns Policy

For items that are not found to be faulty:

East Anglian Model Railways returns policy is as per The Consumer Contracts Regulations 2013.

These Regulations apply in relation to contracts entered into on or after that date. 

Regulations superseded, the following do not apply in relation to contracts entered into on or after 13th June 2014— the Consumer Protection (Distance Selling) Regulations 2000, the Cancellation of Contracts made in a Consumer’s Home or Place of Work etc. Regulations 2008.

As the consumer, you may cancel the sale at any time in the cancellation period without giving any reason, and without incurring any liability except under these provisions-

(a) where enhanced delivery chosen by consumer
(b) where value of goods diminished by consumer handling
(c) where goods are returned by consumer.

Normal cancellation period

The cancellation period ends at the end of 14 days after the day on which the goods come into the physical possession of (a) the consumer or (b) a person other than the carrier, identified by the consumer to take possession of them. 

Exercise of the right to withdraw or cancel.

To withdraw an offer to enter into a distance or off-premises contract, the consumer must inform the trader of the decision to withdraw it, by either phone call or email.

To cancel a contract of sales (under regulation 29(1) Of, The Consumer Contracts (Information, Cancellation and Additional Charges Regulations) the consumer must inform the trader of the decision to cancel it, either by phone or email.

Where the consumer informs the trader by sending a communication by Phone or email the consumer is to be treated as having cancelled the contract in the cancellation period if the communication is sent before the end of the period. 

East Anglian Model Railways must make the reimbursement using the same means of payment as the consumer used for the initial transaction, unless the consumer has expressly agreed otherwise. 

If the value of the goods is diminished by any amount as a result of handling of the goods by the consumer beyond what is necessary to establish the nature, characteristics and functioning of the goods, the trader may recover that amount from the consumer, up to the contract price. 

For the purposes of the above paragraph, handling is beyond what is necessary to establish the naturcharacteristics and functioning of the goods if, in particular, it goes beyond the sort of handling that might reasonably be allowed in a shop.

It is not the responsibility of East Anglian Model Railways to collect the goods, the consumer/purchaser must either (a) send them back, or (b) hand them over to the trader or to a person authorised by the trader to receive them.

The consumer must bear the direct cost/s of returning goods, we are in no way responsible for the cost of returning items.

The address to which goods must be sent is, "Wirrels", Kirkgate, Tydd St Giles,  PE13 5NE, without undue delay and in any event not later than 14 days after the day on which the consumer informs the trader of the cancellation. 

Once your goods have arrived back to the trader, we will refund you by your original payment method unless agreed by the consumer.
